The California Republican Party has filed an emergency application with the U.S. Supreme Court seeking to block the state’s new congressional maps approved under Proposition 50 in November 2025. Republicans argue the legislature-drawn plan illegally prioritizes race in drawing districts, potentially granting Democrats up to five additional House seats and undermining GOP gains elsewhere, such as in Texas. The party is urging the Court to reinstate the prior Citizens Redistricting Commission map for the 2026 midterms.

Submitted on January 20, 2026, and represented by attorneys including the Dhillon Law Group, the filing comes after a federal district court rejected GOP challenges and denied injunctive relief. Proposition 50 amended the California Constitution to allow legislature-drawn maps through 2030, replacing the independent commission. GOP attorneys contend the new plan constitutes unconstitutional racial gerrymandering, prioritizing race over compactness and communities of interest to favor Democrats in an already blue state.

The emergency petition warns that the map could deliver Democrats multiple House gains in a narrowly divided Congress, while highlighting inconsistencies in how courts treat redistricting nationwide. Adding weight, the Trump administration’s Department of Justice filed a statement of interest urging the Court to block the maps. The Supreme Court has now ordered California officials to respond within a week, signaling potential consideration of the GOP’s request. If granted, the injunction would restore the commission-drawn lines, limiting Democratic advantages ahead of a critical midterm cycle.
