Two former New York City police officers have been charged in federal court after prosecutors said they robbed and sexually assaulted a woman working as a sex worker while on duty in Queens.
An indictment unsealed Tuesday in Brooklyn charges former officers Justin McMillan and Justin Colon over a July 2024 incident that allegedly took place in Jackson Heights. Prosecutors say the officers responded to a complaint about prostitution at a residential building on 89th Street near Roosevelt Avenue.
According to court documents, McMillan and Colon turned off their body-worn cameras after arriving at the location. Prosecutors allege the officers then stole a key to the building’s entrance from a woman who had just left the property. The encounter was never reported, and the officers continued their patrol.
Approximately eight hours later, around 4:50 a.m. on July 20, prosecutors say the two officers returned to the building and used the stolen key to gain entry. Inside, they allegedly encountered a woman engaged in a sex act with a customer. The customer fled the scene, leaving the woman alone with the officers in the darkened building.
Prosecutors allege Colon acted as a lookout while McMillan stole cash from the woman’s purse and groped her breast and buttocks. The woman fled the building, and the officers allegedly resumed their patrol before eventually returning to their stationhouse.
Both men resigned from the New York Police Department in March 2025, according to the U.S. Attorney’s Office for the Eastern District of New York.
The indictment charges McMillan and Colon with conspiracy against rights and with willfully depriving the woman of her constitutional rights under color of law, a charge typically used when public officials are accused of abusing their authority. McMillan also faces a separate charge of deprivation of rights related to the alleged sexual abuse.
Both former officers have been arrested. If convicted, each could face up to 10 years in federal prison.
