Colorado Democrats have introduced Senate Bill 97, a measure that would make the state the first in the U.S. to fully legalize prostitution. Sponsored by Democrat Senate Majority Whip Nick Hinrichsen, the bill would repeal current penalties for prostitution, which is presently treated as a petty offense, and permit soliciting, maintaining a place of prostitution, patronizing sex workers, and making displays related to prostitution.
The legislation would also allow advertising for prostitution and escort services, remove the classification of buildings used for prostitution as public nuisances, and prevent local governments from imposing bans. Supporters say the bill offers sex workers legal clarity and safety for consensual adult activity. Co-sponsors include Democrat Senate Assistant Majority Leader Lisa Cutter and Representatives Lorena García and Rebekah Stewart.
The measure has drawn sharp criticism from Colorado law enforcement. Michael Allen, district attorney for the 4th Judicial District and unopposed candidate for state attorney general, called the bill “disgraceful.” He warned that legalizing prostitution could fuel human trafficking, violent crime, drug activity, and organized criminal networks. Colorado ranked 13th nationwide with 88 human trafficking cases in 2024, and preliminary 2025 data show 110 cases, surpassing previous records.
“Coloradans are leaving this state in record numbers because crime is rising and the cost of living is out of control, yet radical Democrats in the legislature are focused on legalizing prostitution,” Allen said, urging fellow Democrats to condemn the legislation.
While the bill bans paying for sex with minors and pimping, it faces opposition from some towns, including Fountain, Monument, and Woodland Park. The ACLU of Colorado supports the legislation. The bill has been assigned to the Judiciary Committee, where Democrats hold a 5-2 majority, but a hearing date has not yet been set. If approved, the law would take effect immediately.
