Former Brazilian President Jair Bolsonaro, serving a 27-year sentence for allegedly leading a plot to overturn the 2022 election, was granted a 90-day temporary house arrest by Supreme Federal Tribunal (STF) Justice Alexandre de Moraes on Tuesday. The decision follows Bolsonaro’s hospitalization for bacterial bronchopneumonia affecting both lungs, which required intensive care.
Bolsonaro, 71, has previously faced repeated denials of humanitarian house arrest despite multiple health issues, including complications from a 2018 assassination attempt. He began serving his sentence in November at the Federal Police in Brasília and was later transferred to a prison cell at Papudinha, part of the Papuda Prison Complex.
The STF ruling allows Bolsonaro to serve his sentence at home with an electronic ankle monitor and medical supervision. Visits from family and attorneys are permitted under prison-like conditions. However, he is prohibited from contacting politicians, allies, or using any form of external communication. Violations could result in a return to prison.
The house arrest coincides with the start of Brazil’s 2026 electoral campaign. Bolsonaro’s son, Senator Flávio Bolsonaro, criticized the temporary nature of the order as “exotic” and highlighted the need for permanent medical supervision at home, with former First Lady Michelle Bolsonaro assisting.
Justice de Moraes noted that the decision is grounded in humanitarian concerns, emphasizing that temporary house arrest is “the most reasonable course of action for the full recovery” of the former president, with the possibility of extension following medical review.
