Former FBI Director James Comey has been charged with allegedly disclosing national defense information to a reporter in October 2016, according to court records unsealed Monday in federal court in Washington, D.C.
The charge alleges that Comey directed the disclosure of a sensitive national security document while serving as FBI director. The case was initially filed on October 5, according to court records, nearly 10 years after the alleged transmission. U.S. District Judge Trevor McFadden has been assigned to the case.
The Justice Department said it filed a criminal information to preserve the statute of limitations while the investigation continues. The filing allows prosecutors to formally bring charges while preventing the limitations period from expiring, a procedure the department said has been recognized by federal courts.
“This is an ongoing criminal investigation, and we will not comment further,” the department said in a statement.
The newly unsealed case provides few additional details about the document allegedly disclosed or the circumstances surrounding its transmission. Comey is presumed innocent unless proven guilty.
The case marks another federal prosecution involving Comey. A previous case against the former FBI director was dismissed, while he also faces a separate criminal charge in North Carolina related to an alleged social media threat against President Donald Trump.
The latest charge focuses on the alleged disclosure of national defense information during Comey’s final months leading the FBI in 2016. Further details are expected to emerge as the case proceeds through federal court.
