Rep. Max Miller, R-Ohio, is demanding that Cleveland television station WKYC stop airing a campaign advertisement from Democratic challenger Brian Poindexter that accuses Miller of domestic abuse.

Miller’s attorney, Alejandro Brito, sent WKYC a cease-and-desist letter on Sept. 17 calling statements in the 30-second advertisement “false, malicious, and defamatory.” The letter demands that the station stop airing the ad, issue a retraction and apology, and compensate Miller, warning that he could pursue legal action if the demands are not met.

The advertisement features Summit County Sheriff Kandy Fatheree recounting allegations made by Miller’s former wife, Emily Moreno, including claims that Miller held a gun to her head and that their young daughter suffered a broken collarbone while in his care. Miller has denied the allegations and has not been criminally charged in connection with them.

Miller’s attorney disputes the claims in the advertisement. The letter says Moreno, the daughter of Ohio Sen. Bernie Moreno, does not have a restraining order against Miller as the ad claims and instead points to a civil protection order Miller obtained against Moreno in February. It also cites Miller’s sworn denial of the abuse allegations and county investigations into his daughter’s injury.

Poindexter has defended the advertisement and accused Miller of trying to prevent voters from hearing the allegations. The Democratic challenger has made the accusations a central part of his campaign against Miller in Ohio’s 7th Congressional District.

The dispute adds a legal fight to an increasingly contentious House race, with Miller seeking another term while Poindexter uses the allegations to attack the Republican incumbent. The claims remain disputed, with Miller maintaining that the allegations against him are false.
