Former Minneapolis police officer Derek Chauvin filed a petition this week the Minnesota Court of Appeals requesting immediate dismissal of his state murder conviction in the death of George Floyd.

Chauvin's attorney, Gregory Joseph, submitted the third petition for postconviction relief, arguing structural error in the charges and violations of due process rights. The filing specifically challenges the assignment of the case to Minnesota Attorney General Keith Ellison as illegitimate.

The petition seeks to have the conviction vacated and the charges dismissed. Court records show the document was filed August 18.

Chauvin was convicted in 2021 of second-degree murder and other charges in Floyd's death and sentenced to 22.5 years in state prison. He also faces a separate federal sentence.

Prior appeals in state court were denied, and the U.S. Supreme Court declined to review the case in 2023.

The latest motion continues Chauvin's efforts to challenge the conviction on procedural and constitutional grounds.
